Featured Listings Terms & Conditions

These Terms & Conditions govern participation in the Featured Listings program offered by Omalocs Beauty LLC through the Get Microlocs Near Me platform. Please read carefully before purchasing a Featured Placement.

FEATURED LISTINGS TERMS & CONDITIONS

Effective Date: 02/15/2026

These Featured Listings Terms & Conditions (“Agreement”) constitute a legally binding agreement between you (“Featured Partner,” “you,” or “your”) and Omalocs Beauty LLC, a New York limited liability company (“Omalocs Beauty,” “Company,” “we,” “us,” or “our”), governing participation in the Featured Listings program on the Get Microlocs Near Me platform (the “Platform”).

By purchasing or participating in a Featured Listing, you acknowledge and agree to be bound by this Agreement.

These Featured Listings Terms & Conditions supplement and operate alongside the general Terms of Use of the Platform.

1. Program Description

The Featured Listings program provides enhanced visibility placement on designated state pages of the Platform, subject to availability, eligibility, and Company approval.

Participation is not guaranteed and may be denied at the sole discretion of Omalocs Beauty.

2. Term; Fees; Payment

2.1 Term

The Featured Listing term is twelve (12) consecutive months.

The term commences on the date the Featured Placement and associated brand page are confirmed live on the Platform and continues for twelve (12) uninterrupted months (“Term”).

No pauses, extensions, or suspensions shall extend the Term unless expressly agreed to in writing by the Company.

2.2 Fees

  • Standard Annual Rate (2026): $400 USD

  • Promotional Early Access Rate: $300 USD (limited-time offer)

All fees are:

  • Due in full prior to activation

  • Non-refundable

  • Non-transferable

  • Final

The Featured Listing is a 12-month commitment. Early termination by Featured Partner does not entitle Partner to any refund, credit, or prorated reimbursement.

2.3 Renewal

Featured Listings do not automatically renew.

The Company will provide renewal notice approximately forty-five (45) days prior to expiration. Renewal occurs only upon receipt of full payment prior to expiration.

If payment is not received before expiration, Featured Placement will automatically terminate without further notice.

3. Scope of Featured Placement

3.1 Guaranteed Deliverables

Subject to compliance with this Agreement and full payment, Featured Placement guarantees the following during the Term:

  1. Inclusion within the Featured Section located at or near the top of the applicable state page.

  2. Creation and hosting of an SEO-optimized brand page containing your approved business information, images, and publicly shared contact details, which shall be linked from the applicable state page.

  3. Display of a “Featured Partner” badge on your SEO-optimized brand page.

The Company retains full editorial control over layout, formatting, optimization, and presentation.

3.2 Placement Discretion

The Company retains sole and absolute discretion regarding:

  • Ordering within the Featured Section

  • Rotation frequency

  • Layout and design

  • Visibility format

  • Page structure

  • Platform updates

Featured Placement does not guarantee a fixed ranking position within the Featured Section.

3.3 No Additional Guarantees

Featured Placement does not include or guarantee:

  • Homepage placement

  • App placement

  • Email marketing inclusion

  • Social media promotion

  • Exclusivity within a state or city

  • Traffic minimums

  • Click minimums

  • Leads

  • Bookings

  • Revenue

  • Conversion rates

Any additional marketing exposure is at the sole discretion of Omalocs Beauty.

4. No Performance Representations

Omalocs Beauty makes no representations or warranties regarding:

  • Website traffic

  • Search engine performance

  • SEO ranking

  • User engagement

  • Business growth

  • Client acquisition

The Platform functions solely as a visibility and discovery directory. The Company does not process bookings, track attribution, or guarantee business results.

5. Availability; Caps; Structural Changes

Featured spots are currently capped by state (generally 6–8 per state based on demand).

The Company reserves the right, at any time and without prior notice, to:

  • Modify state caps

  • Introduce city-level caps

  • Expand or reduce Featured capacity

  • Restructure Featured placement

  • Modify program structure

Participation in one Term does not guarantee eligibility for future Terms.

6. Content Submission; Credentials; Verification

6.1 Required Materials

Featured Partner must provide:

  • 4 – 6 high-resolution professional images of prior work

  • Headshot

  • Business logo (if applicable)

  • Accurate business description

  • Valid credential disclosures

6.2 Editorial Rights

The Company reserves the unrestricted right to:

  • Edit, revise, reformat, or optimize submitted materials

  • Reject materials that do not meet quality standards

  • Remove misleading or inaccurate content

  • Standardize formatting across the Platform

6.3 Credential Verification

If you represent any professional credential, including but not limited to:

  • State cosmetology licenses

  • Barber licenses

  • Natural hair licenses

  • Sisterlocks® certification

You authorize the Company to verify such credentials through official databases and registries.

The Company reserves the right to:

  • Remove badges

  • Remove certification indicators

  • Request updated documentation annually

  • Suspend or remove listings for misrepresentation

  • Remove listings if licenses expire or cannot be verified

Credential misrepresentation constitutes material breach.

7. Code of Conduct; Suspension; Removal

The Company may suspend or remove a Featured Listing, without refund, if Featured Partner:

  • Engages in fraudulent conduct

  • Misrepresents credentials

  • Engages in harassment or discrimination

  • Engages in unsafe or unlawful practices

  • Causes reputational harm to the Platform

  • Initiates abusive or bad-faith chargebacks

  • Violates any provision of this Agreement

The Company may remove listings immediately in cases of serious misconduct.

The Company is not obligated to provide notice, cure period, or prorated refunds in cases of material breach or misconduct.

8. Payment Failures; Chargebacks

Payments are processed via Stripe.

If payment:

  • Fails

  • Is reversed

  • Is disputed

  • Is subject to chargeback

The Company may:

  • Immediately suspend placement

  • Remove listing

  • Deny future participation

  • Recover associated fees and administrative costs

Abusive chargebacks constitute material breach.

9. Intellectual Property License

By submitting content, you grant Omalocs Beauty a perpetual, non-exclusive, royalty-free, worldwide license to:

  • Display your content on the Platform

  • Use your content for marketing

  • Use your content in email communications

  • Use your content on social media

  • Use your content in promotional materials

You represent and warrant that you own or have legal rights to all submitted content and that such content does not infringe third-party rights.

10. Platform Status; No Agency Relationship

The Platform is a directory and discovery service only.

The Company:

  • Does not act as agent or representative

  • Does not process bookings

  • Does not collect service payments

  • Does not supervise services

  • Does not mediate disputes

All client relationships are formed directly between Featured Partner and client.

11. Limitation of Liability

To the maximum extent permitted by law:

The Company shall not be liable for any:

  • Direct damages

  • Indirect damages

  • Consequential damages

  • Lost profits

  • Lost business opportunities

  • Reputational harm

  • Service disputes

Total aggregate liability shall not exceed the total amount paid by Featured Partner for the applicable Term.

12. Indemnification

Featured Partner agrees to indemnify, defend, and hold harmless Omalocs Beauty from any claims, damages, liabilities, losses, or expenses arising from:

  • Services performed

  • Client disputes

  • Credential misrepresentation

  • Submitted content

  • Violations of law

13. Modifications

The Company reserves the unilateral right to modify:

  • Program structure

  • Pricing

  • Placement format

  • These Terms

Updated terms become effective upon posting.

14. Governing Law

This Agreement shall be governed exclusively by the laws of the State of New York.

Any disputes shall be resolved exclusively in the state or federal courts located in New York.

15. Acceptance

By purchasing a Featured Listing, you acknowledge that you:

  • Have read this Agreement

  • Understand its terms

  • Agree to be legally bound
